These terms and conditions outline the rules and regulations for the use of Epiphany's Website, located at https://www.epiphanyorg.com.
By accessing this website, we assume you accept these terms and conditions. Do not continue to use Epiphany if you do not agree with the terms and conditions stated on this page.
1. Services Overview
Epiphany provides therapy and counselling using an eclectic approach. This means that one or more therapeutic models may be used depending on what is considered appropriate for the client. Different individuals may require different techniques, and methods may change over the course of treatment. Clients are encouraged to communicate if any part of the process feels uncomfortable or unsuitable.
A consent form (therapeutic contract) will be issued once payment and slot confirmation are completed. By signing this form, you authorise Epiphany to provide therapy or counselling services. Policies and procedures may be updated from time to time, without prior notice.
1.1 No Crisis or Emergency Care
Epiphany is not an emergency/self-harm/crisis/harmful situation service provider.
If you are in immediate danger, at risk of harm, or experiencing a crisis, please contact local emergency services or a suicide/crisis helpline in your area. These Terms do not cover crisis intervention, and our team is not available 24/7 for emergencies.
1.2 No Medical or Psychiatric Diagnosis
Epiphany does not diagnose mental health disorders or prescribe medication at present.
If you require a clinical diagnosis or medication management, we recommend consulting a licensed medical professional or psychiatrist in your region. Our Services may complement but do not replace medical or psychiatric care.
1.3 Confidentiality
All sessions are confidential between the client and the therapist. Therapists may maintain professional case notes as part of treatment. These notes are accessible only to the therapist and, where required, to Epiphany supervisors for quality and ethical oversight.
No personal or identifying information, like names and numbers, will be shared without the client’s explicit consent, except where required by law or necessary for safety.
Clients agree to attend sessions from a private location using a secure connection. Recording of sessions by any party is strictly prohibited. Session content may not be shared or distributed without explicit consent, including other individuals, families, any third persons or social media
While reasonable technical safeguards are used, neither the client nor Epiphany shall not be held responsible for breaches caused by technological limitations.
1.4 Mental Health Act Provisions
A person with mental illness shall have the right to confidentiality in respect of their mental health, mental healthcare, treatment and physical healthcare.
All health professionals providing care or treatment to a person with mental illness shall have a duty to keep all such information confidential which has been obtained during care or treatment with the following exceptions, namely:
(a) release of information to the nominated representative to enable them to fulfill their duties under this Act;
(b) release of information to other mental health professionals and other health professionals to enable them to provide care and treatment to the person with mental illness;
(c) release of information if it is necessary to protect any other person from harm or violence;
(d) only such information that is necessary to protect against the harm identified shall be released;
(e) release only such information as is necessary to prevent threat to life;
(f) release of information upon an order by concerned Board or the Central Authority or High Court or Supreme Court or any other statutory authority competent to do so;
(g) release of information in the interests of public safety and security;
(h) information accessible to the administration team of Epiphany for smooth functioning of the organization;
(i) information accessible to supervisors of therapists to ensure quality of sessions is maintained for all clients
1.5 Minors
We do not provide any services to minors at present. By using our website, services, or engaging with any social media, you acknowledge that you are 18 years of age or above.
1.6 Dutiful Warning
If there is reasonable belief that a client presents a risk of serious physical, emotional or other harm to themselves or others, Epiphany may notify appropriate persons or authorities, including medical or law enforcement services.
1.7 Interactions and Communication Outside of Sessions
The relationship between the client and Epiphany is strictly professional and therapeutic. Personal, social, financial, or business relationships are not permitted, since they undermine the primary therapeutic alliance and relationship. Gifts, bartering, or exchanges of services are prohibited.
Communication outside sessions is limited to scheduling and administrative matters. Any correspondence via text, social media, or informal messaging cannot be considered as dispensing a therapeutic service.
Content shared on Epiphany’s website or social platforms are for building awareness and cannot be considered as therapy or a helpline, not is it a substitute for the same.
1.8 Consent to Transfer
By signing the consent form, clients agree not to continue therapy privately with therapists working at Epiphany outside the organisation during or after the period of affiliation.
If a therapist is no longer affiliated with Epiphany, the client consents to be transferred to another practitioner. Clients consent to internal transfer of case notes for continuity of care. Notes remain confidential within Epiphany. If the need to transfer arises, you will duly informed.
This policy exists to ensure adherence to Epiphany’s professional standards and oversight. By signing the consent form, you agree understand that taking private sessions with a therapist is against the legal contract between the therapist and Epiphany.
1.9 Consent to Treatment
By signing the consent form, the client voluntarily agrees to receive therapy or counselling services from Epiphany and understands that participation is collaborative. You agree to be an active participant in the process of planning your care, taking part in therapy and any other services. You understand you are free to discontinue services at any time. By signing the consent form, you acknowledge that you have read and understood the entirety of these terms
Epiphany reserves the right to terminate services where client behaviour compromises safety, ethics, or professional boundaries, and therapists working at Epiphany reserve the right to discontinue therapy for their own mental health and security.
1.10 Risks and Benefits of Therapy
Therapy is a collaborative effort between the client and the therapist, and may result in improved emotional, relational, and psychological functioning. Examples of this include but are not limited to feeling more confident, having lesser stress, handling challenges effectively and having better relationships. Achieving these results require honesty and active participation from the client to change behaviours, talk through their issues and overall have willingness to change and try new things, and be open minded to the process of therapy. Outcomes vary and are not guaranteed.
Therapy may involve discussion of distressing experiences and may temporarily increase discomfort. Change may be gradual and unpredictable, and there may be times where the client's beliefs and actions may be challenged. At times, it might feel like its getting worse, but it is usually that it gets worse before it can get better. Clients are free to address these touchpoints in sessions, and discuss their progress.
Sometimes, the issues presented by clients may lead to unintended outcomes, like changes in personal relationships, career and so forth. Epiphany will not be held liable for any results or outcomes of therapy or any of its services. Clients remain responsible for all of their personal decisions.
1.11 Self-Harm and Emergencies
Self-harm, and suicide, which is ending one's life, is a tragic event with strong repercussions for the individual undertaking it and their immediate circle. Epiphany is not a crisis service and emergency care is not provided. Clients experiencing immediate danger must contact local emergency or crisis services.
Self-harm and suicide are self-directed, impulsive acts take an individual and Epiphany and its practitioners cannot be held responsible for any such acts of self-harm or suicide.
1.12 Legal Proceedings
We will not voluntarily participate in any litigation, or custody dispute in which client and another individual, or entity, are parties. We have a policy of not communicating with client’s attorney and will generally not write or sign letters, reports, declarations, or affidavits to be used in a legal matter unless agreed upon at the beginning of the therapeutic relationship. We will generally not provide records or testimony unless compelled to do so. Should we be subpoenaed, or ordered by a court of law, to appear as a witness in an action involving a client; the client agrees to reimburse us for any time spent or preparation, travel, or other time in which we have made ourselves available for such an appearance at our usual and customary fees.
Epiphany is not to be held liable for any criminal actions conducted by therapists working at Epiphany.
2. Session Policies
It is the client's responsibility to manage their coaching time, payments and subscriptions and keep these policies in mind. Clients are requested to be mindful of how much time they have left and how much they are using. Reminders will be given, but the session will be terminated if it goes over 60 minutes.
2.1 Refund policy
Your session time purchases are non-refundable.
2.2 Cancellation and no-shows
No-shows, or not showing up to the session, as well as cancellations less than 24 hours, are considered as short notice and is charged the full price of the session at your rate. Sessions can be held for 10 minutes from the appointment time, and will have to be cancelled after that. No-show and cancellation fees are no refundable.
2.3 Session Time Rollover Policies
Any unused time rolls over from month to month, but is forfeited after 3 months of not receiving contact from the client, or 6 months from the date of purchase.
If subscriptions roll over for 6 weeks without use/inactivity they will be automatically cancelled and can be renewed upon return. You will get a message from us about it one month (30 days) of being inactive, and cancelled 2 weeks after that date. The time left in yoru account will be unaffected and still be in your account available to use within the expiry date and are subject to the same policies above.
3. Payment and Fees
Payment is accepted through UPI/GPay/Paytm/PhonePe/Bank Transfer/Remitly/Wise/Revolut. Payment is required to secure your slot. If payment is not received at least 24 hours in advance, it might result in an automatic cancellation of your slot and you would need to rebook.
4. License
Unless otherwise stated, Epiphany and/or its licensors own the intellectual property rights for all material on Epiphany. All intellectual property rights are reserved. You may access this from Epiphany for your own personal use subjected to restrictions set in these terms and conditions.
5. Intellectual Property
All content and material by Epiphany and any other additional material provided through Services (including text, graphics, logos, videos, frameworks such as the Compass, and other materials) are the property of Epiphany or its licensors and are protected by copyright and other intellectual property laws.
You may not:
Copy or republish material from Epiphany
Sell, rent, or sub-license material from Epiphany
Reproduce, duplicate or copy material from Epiphany
Redistribute content from Epiphany
6. Limitation of Liability
To the fullest extent permitted by law, Epiphany and its providers are not liable for any indirect, incidental, special, or consequential damages resulting from your use of our Services. Our total liability for any claim arising out of these Terms will not exceed the amount you paid for the session in question.
7. Governing Law and Jurisdiction
These Terms are governed by the laws of India, and any disputes will be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka, unless otherwise required by law.
8. Changes to These Terms
We may update these Terms and Conditions from time to time. The policies mentioned on this website or the consent form may be subject to change without prior notice.. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.
